<p>This is a translated portion of Bynkershoek’s (sometimes translated Bijkenshoek) 1737 work <em>Quaestiones juris publici</em>. Bynkershoek (1673-1743) was a Dutch jurist in the period following <a href="https://scholarship.law.wm.edu/exhibit/war-law-philosophy-perceptions/de-jure-belli-ac-pacis-libri-tres/">Grotius</a>, who contributed to a positivist theory of international law. His contribution to the law of war includes his idea that “war is by its very nature so general that it cannot be waged within set limits” and the modern concept of neutrality that has since been widely influential.</p>
